Delhi High Court has dismissed the petition of Gautam Gambhir over the use of his name as a tagline for the business of its eateries and lounges. The Delhi based local restaurant and bar of DAP and Co. was alleged to have used the name of the cricketer in order to grab the eyeballs of the customers. However, they have been allowed to use the same now by rejecting the plea of the Indian discard player on Wednesday.
Gambhir is currently preparing for the semifinals of the ongoing season of Ranji Trophy against Bengal at Maharashtra Cricket Association Stadium in Pune. He has blown hot and cold in the first-class season so far but has looked solid more often during his brief stay at the crease. He batted well in the chase of 217 against Madhya Pradesh in the quarterfinal last week and would look to give his everything to help Delhi make it to the final of the tournament.
DAP and Co. defends
Gautam Gambhir had mentioned in his plea that the use of his name appeared to be “deceivingly associated or owned” by him and would, therefore, cause “irreparable loss and undue hardship” to him. Though DAP and Co. the defendant claimed that they used the tagline by the name ‘Gautam Gambhir’ because it is the name of the proprietor who also owns two pubs, Ghungroo and Hawalat, in Delhi’s Punjabi Bagh area.
Justice S. P. Garg dismissed his petition on the given evidence by the proprietor that even his name was Gautam Gambhir. However, the rejection of plea is somewhat a setback for Gambhir whose future earnings might be affected by this. Also now they will use the same tagline in the near future which will just worry the cricketer a little bit more and also might have to explain to the people more often that it is not his brand.
