Delhi Court restrains Aesha Mukerji from making defamatory comments about Shikhar Dhawan
Delhi court asked Aesha Mukerji to complain to the government bodies in case of any grievances.
A family court in New Delhi recently asked Shikhar Dhawan's estranged wife, Aesha Mukerji, from refraining to post anything defamatory or negative against the cricketer on social media or anything to the press to tarnish his image. Justice Harish Kumar in the meantime asked Aesha to voice her grievances to competent authorities in India and Australia, if she has any issues with the Delhi-born cricketer.
The order passed by the judge stated that the reputation of a person is very dear to everyone and thus, one doesn’t have the right to tarnish it.
“Reputation of a person is dear to everyone and is considered as property of highest degree because materialistic property can be regained after loss but reputation cannot be regained once damaged. Therefore, it has got to be protected. However, it is equally true that if anyone has lawful grievance against someone, he or she cannot be restrained from venting out his or her grievance to concerned authority,” Kumar was quoted as saying by barandbench website.
Furthermore, the judge took note of things in public interest. Emphasizing on the same, he remarked that without having the approached the relevant authorities, Mukerji cannot spread any personal information in the public domain or with friends or relatives of Dhawan.
"Therefore, in these circumstances, she is hereby restrained till further order from circulating any of her grievance against Dhawan or her version of the dispute involved herein or the alleged defamatory and false material against the him, to social media, to print media or to any other' forum or to friends, relatives or colleagues of the parties," the Patiala house court judge added.
Talking of further proceedings, in a plea filed by Dhawan's advocate, Aman Hingorani, the cricketer was accused of mistreating Mukerji along with not providing a suitable allowance to her. However, as per Dhawan's lawyer, the cricketer has been paying an amount of Australian $17,500 per month (inclusive of mortgage payments) along with payment of school fees and beyond to her on a regular basis.
Therefore, Shikhar Dhawan, executed this latest move to curb any amplification of any false information or accusation related to him through social media or any other mediums. Only time will tell how things will pan out for Dhawan in future regarding this matter.
